Bosnia’s Energoinvest plans to challenge a ruling on natural gas transportation charges before the Supreme Court of the Republic of Srpska, arguing that the dispute could affect the wider application of regulated network tariffs.
The Sarajevo-based gas importer said transport charges should remain within the tariff framework approved by the competent regulator. It warned that allowing network users to be billed at different rates could weaken legal certainty and undermine the regulatory system.
The move follows a second-instance judgment by the Higher Commercial Court of the Republic of Srpska and subsequent public statements by Sarajevo-Gas Istocno Sarajevo.
Energoinvest said it had reviewed the ruling and would seek a revision within the statutory deadline. The company said the second-instance decision did not exhaust the legal remedies available to it.
The dispute also raises the question of whether transportation fees are being applied consistently to every company using the gas network.
The Supreme Court proceedings could therefore have consequences beyond the immediate financial claims of the two companies. A decision clarifying how approved tariffs must be applied would affect the predictability of gas transport costs and contractual relations across Bosnia’s fragmented gas market.
