Romania: No more tax on wind towers for wind energy producers

Wind energy producers in Romania will no longer pay the tax on turbine towers, which was required by an older provision in the Fiscal Code, which referred to the tower as to a building, therefore for which tax was due, according to a decision of the Supreme Court.

The law firm Tuca Zbarcea & Asociatii said that the High Court of Cassation and Justice maintained the decision by which several companies in the field of wind energy had obtained in the first instance the annulment of the Order of the Minister of Public Finance 1210/2014 and the Decision of the Central Fiscal Commission 5/2014.

Five of the most important companies active in the renewables sector, represented by Tuca Zbarcea & Asociatii, initiated the action suit having as object the request for annulment of the Order of the Minister of Public Finance 1210/2014 and the Decision of the Central Fiscal Commission 5/2014. Other companies in the field of wind energy later joined this action.
